These Terms of Service (“Terms”) govern your access to and use of the SmileVerse Dental Clinic website at https://www.smileverseclinic.com (“Website”). By accessing the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

1. Use of the Website

1.1 You may use our Website to learn about our dental services, contact us, and request appointments. You must be at least 18 to use the Website independently; users under 18 may use it only under parental or guardian supervision.

1.2 You agree not to: violate any applicable law; attempt unauthorized access to our systems; use automated tools to scrape or extract data; submit false or misleading information; impersonate SmileVerse or any other person; or interfere with Website functionality.

1.3 We may update these Terms at any time. Material changes will be posted with an updated effective date. Continued use of the Website after any change constitutes acceptance of the revised Terms.

2. No Doctor-Patient Relationship via Website

2.1 Using our Website — including submitting a contact form, requesting an appointment, or reading our content — does NOT create a dentist-patient relationship between you and SmileVerse Dental Clinic or any of its licensed dental professionals.

2.2 A dentist-patient relationship is established only after you: (a) attend an in-person appointment at our office; (b) are formally accepted as a patient; and (c) complete required intake and informed consent documentation at our office.

2.3 All content on the Website is for general educational and informational purposes only. It is not dental or medical advice. Do not rely on Website content as a substitute for professional dental evaluation. In a dental or medical emergency, call 911 or proceed to your nearest emergency room immediately.

2.4 Results shown in our smile gallery represent individual patient outcomes and do not constitute a guarantee. Dental results vary by individual and depend on many clinical factors.

3. Appointment Scheduling

3.1 Online appointment requests do not constitute confirmed appointments. All appointments must be confirmed by a SmileVerse team member.

3.2 Our online booking is powered by the Archy patient portal (https://www.archy.com). Use of the portal is subject to Archy’s Terms of Service and Privacy Policy. SmileVerse is not responsible for the availability or functionality of the Archy platform.

3.3 Cancellation Policy: We require a minimum of 48 hours’ advance notice for cancellations. Late cancellations or no-shows may result in a fee per our office financial policy, provided at the time of scheduling. Repeated no-shows may result in discharge from the practice.

3.4 SmileVerse reserves the right to cancel or reschedule appointments due to unforeseen circumstances. We will notify affected patients as promptly as possible.

4. Financial Terms and Payment

4.1 Payment is due at the time of service unless prior arrangements are made with our billing department. We accept major credit cards, debit cards, cash, and check. Third-party financing options (e.g., CareCredit) may be available subject to credit approval.

4.2 Payments are processed through Archy, which uses Finix as its payment infrastructure (PCI-DSS compliant). Payment card data is stored within Archy’s secure platform. SmileVerse does not maintain payment card data on its own servers.

4.3 Insurance: It is the patient’s responsibility to verify coverage and benefits prior to service. SmileVerse will make good-faith efforts to estimate insurance coverage but cannot guarantee payment. The patient is responsible for all charges not covered by insurance, including deductibles, copayments, and non-covered services.

4.4 Fee estimates provided before treatment are estimates only and subject to change based on the actual scope of treatment.

5. Intellectual Property

5.1 All Website content — including text, images, graphics, smile gallery photos, logo, and branding — is the exclusive property of SmileVerse Dental Clinic or its licensors, protected by copyright and trademark law.

5.2 You are granted a limited, personal, non-commercial license to view Website content. You may not reproduce, distribute, modify, or use SmileVerse’s name or logo without written consent.

6.1 Reviews, testimonials, and social media posts mentioning or tagging SmileVerse may be used for marketing and educational purposes. By posting publicly about SmileVerse, you grant us a non-exclusive, royalty-free, perpetual license to share that content, unless you expressly request removal in writing.

6.2 Testimonials represent individual patient experiences and are not guarantees of results. Patient photos are shared only with written HIPAA-compliant patient authorization.

6.3 SmileVerse reserves the right to remove social media comments that are defamatory, abusive, false, or that violate HIPAA privacy.

7. Advertising and Promotional Offers

7.1 SmileVerse may advertise on social media platforms and via Google Ads. All advertising complies with applicable law, including the Texas State Board of Dental Examiners (TSBDE) guidelines and Texas dental advertising rules (22 Tex. Admin. Code Chapter 107).

7.2 Promotional offers are subject to availability, may be changed or discontinued without notice, are non-transferable, not redeemable for cash, and may not be combined with other offers unless explicitly stated.

7.3 Raffles and giveaways are governed by specific rules published with each promotion and comply with applicable Texas law.

8. Disclaimers and Limitation of Liability

8.1 THE WEBSITE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 TO THE FULLEST EXTENT PERMITTED BY LAW, SMILEVERSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE WEBSITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE WEBSITE SHALL NOT EXCEED $100.00.

8.3 Nothing in these Terms limits liability for: (a) death or personal injury caused by negligence; (b) fraud; (c) dental malpractice claims arising from in-person treatment governed by Texas law; or (d) liability that cannot be excluded under applicable law.

9. Indemnification

You agree to indemnify and hold harmless SmileVerse Dental Clinic, its owners, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Website, your violation of these Terms, or your violation of any third-party rights.

10. HIPAA Acknowledgment

Use of this Website or submission of any online form does not create a patient record or trigger HIPAA protections. For sensitive health matters, contact our office by phone at (281) 482-3331 or in person. HIPAA protections apply to PHI created in connection with in-person dental care, as described in our HIPAA Notice of Privacy Practices (Part Two of this document).

11. Accessibility

SmileVerse is committed to making our Website accessible to individuals with disabilities consistent with WCAG 2.1 Level AA guidelines. 12. Governing Law and Disputes

12.1 These Terms are governed by the laws of the State of Texas without regard to conflict-of-law principles.

12.2 Any legal action arising from these Terms or the Website shall be brought exclusively in state or federal courts in Galveston County or Harris County, Texas.

12.3 Before filing any formal legal action, you agree to contact SmileVerse in writing and attempt good-faith resolution for 60 days.

13. General Provisions

Severability: If any provision is found unenforceable, the remaining provisions remain in full force and effect.

Entire Agreement: These Terms, our Privacy Policy, and our HIPAA NPP constitute the entire agreement between you and SmileVerse regarding the Website.

No Waiver: Failure to enforce any provision is not a waiver of future enforcement.

Force Majeure: SmileVerse is not liable for delays or failures caused by events beyond its reasonable control.
